🌮 How do I get a prepared food concession business in Green Bay, WI licensed and registered?

Lafawnda wrote: “I make homemade food with love and affection in Green Bay, WI, and I make it the way you like it. I deliver to the surrounding areas.”

Hi Lafawnda, Lafawnda's Grub is off to a smart start by getting the paperwork right first. Hungry crowds at festivals and farmers markets are ready to buy on the spot, and a signature dish like fresh empanadas can build a loyal following fast. Since your goals are to protect your personal assets, limit exposure from sales, clients, employees, or debt and raise capital or sell shares, the LLC sits at the center of this plan. Here is what we will cover: how to structure Lafawnda's Grub, the tax IDs it needs, and the licenses that let you open in Green Bay, then a quick recap.

Cooking with love is the easy part; in Wisconsin, selling cooked meals is another matter, because home-kitchen exemptions generally cover only certain baked or canned goods, not hot dishes delivered to neighbors. Plan on cooking in a licensed commercial kitchen, or ask about the food license that fits your menu. Delivered prepared food is taxable, so a Wisconsin seller's permit belongs in your setup. An LLC makes more sense here than most places, since one bad stomach and one angry customer can become a claim against you personally, and its operating agreement can welcome partners or investors if the grub takes off. Your delivery car needs the right insurance too. What Lafawnda's Grub needs LLC (limited liability company) – An LLC keeps business debts and lawsuits separate from your personal home and savings. If several customers fall ill after eating at your booth and file suit, an LLC shields your house and savings. Once profits grow, an LLC can elect S corporation tax treatment, which can lower self-employment tax; ask a tax adviser when the numbers justify it. If you plan to sell shares to investors, a corporation may fit better later, and an LLC can convert when that day comes.DBA (doing business as) registration – If you operate as a sole proprietor, or under a name different from your LLC's exact legal name, registering "Lafawnda's Grub" lets you use it on signs, invoices, and your business bank account.EIN (federal tax ID number) – Think of the EIN as a Social Security number for the business: banks, suppliers, and clients who send you tax forms will all ask for it.Wisconsin sales tax permit (seller's permit) – You will be selling taxable goods, so register to collect sales tax before your first sale. It also lets you buy inventory for resale without paying tax on it.Business license – Most places require a local business license to operate, including home-based businesses. Check the rules where Lafawnda's Grub will operate in Green Bay, and ask about home occupation and zoning rules if you work from home. Home occupation rules commonly cap client visits and delivery trucks on a residential street, so read them before you print business cards.Food service permit – Selling cooked food at markets or festivals typically requires a permit and inspection, and some areas require a licensed commissary kitchen.Food handler card – Many states require food workers to finish a basic food safety course.

By the numbers: Banks, insurers, and tax forms will ask for your industry code. For a prepared food concession business it is NAICS 722330 (Mobile Food Services). That makes 7 items on your list.

Tip: Ask whether your area allows home-cooked food for sale under cottage food rules before cooking in your own kitchen.

To recap: Lafawnda's Grub in Green Bay, WI needs an LLC, a DBA, an EIN, a sales tax permit, a business license, food service permit, and food handler card. Check them off one by one and you will open with confidence.

Hi William, we can help you register for our Food Service in Lomita, CA, 90717.
Note that nonprofit requires a nonprofit corporation and bylaws as well as a tax exemption.
First,
thing to do is the entity tax structure selection. There are 4 main types of tax entity business structures, namely, sole proprietor, LLC , Partnership or Corporation.

You need to select one because you will be taxed as the entity type you select and also, the rest of the documents, such as the seller's permit, will be registered under the entity you chose.

That said, keep in mind, you cannot be the sole proprietor and file a seller's permit as an LLC unless you obtain an LLC certificate.
In your case, since you showed an interest that you prefer an LLC , then form an LLC .

Second,
Because Food Service is subject to sales tax, you will need to obtain a seller’s permit. So, for example, if you sell Food at $5, you need to charge tax. If the tax is 10%, then you need to charge the client $5.50 for the food.

Third,
Furthermore, note that all businesses need to obtain a business license.

Finally,
If you hire food waitresses and other personnel, you will need to obtain a federal and state EIN as well, so you can pay federal and state withholding employment taxes.

REQUIRED LLC LIMITED LIABILITY DOCUMENTS AND LICENSES
LLC Refers to the Legal Company Structure

The Food Service legal structure is selected during business registration. If you choose to be an LLC , you do not need to file a Doing Business As (DBA) Certificate. About 60% of new businesses select an LLC when choosing a corporate structure. For example, if you are the Food Service sole owner, you can file a DBA and so select the sole proprietorship structure or select the LLC structure to be a corporate entity because LLC afford corporate protections such as business and personal liability protections.

Thus, when starting a business whether an online, home, store, concession stand or a mobile cart, you will need to first select among sole owner/proprietor, partnership, LLC or corporation, all of which also require a General Food Service Business License (not a specific license to your type of business, necessarily but a requirement for LLC companies as well as necessary) for any business as well.

If you decide to be a sole proprietorship instead of a Food Service LLC , and the trade name is a business name other than your full personal legal name, you will need to file a Doing Business As (DBA) Certificate. For instance, if your name is John Doe, and you do business as Best Food Service Items By John, the name must be registered with a DBA Biz Name document is called a DBA certificate because Best Items By John is not your full legal name.
LLC

Also, note that whatever item that you sell or lease, and it is an item that can be touched (i.e., tangible items such as equipment, toys, merchandise, electronics, prepared food) requires a state sales tax ID (Sellers Permit) to either buy or sell the items or wholesale and sell them in retail. If you or your LLC are hiring workers within the next 30 days, you will need a Federal EIN and a State EIN (employer identification number).

Even if you treat the LLC as a disregarded entity, you can use your social security to conduct business, it is not recommended. Other instances that you will need a federal tax ID: if you are a partnership, an independent contractor, and a corporation or an LLC treated as a corporation. You can also obtain a federal tax ID as the sole proprietor and use it as a business tax ID in place of a social security number.

However, all Food Service businesses need at least 2-5 business registrations, so you will still need other registrations, such as licenses, an assumed business name DBA, and tax IDs as described above. Finally, even one person, sole owner/proprietors working from home or just online can form an LLC or incorporate, in which case, they will not need to file a DBA, and they will be members of the LLC .

Answer:

Hi William, we can help you register for our Food Service in Hammond, Boone County, IN. The EIN is required but also some other licenses as described below:

First,
thing to do is the entity tax structure selection. There are 4 main types of tax entity business structures, namely, sole proprietor, LLC , Partnership or Corporation.

You need to select one because you will be taxed as the entity type you select and also, the rest of the documents, such as the seller's permit, will be registered under the entity you chose.
Since you are in a very risky business (for example, you can cause food poisoning and be subject to lawsuits), it is a good idea to incorporate or form an LLC , so you can be protected from personal liability.

The sales tax rate for most states ranges from 4% to almost 10%.
Third,
Furthermore, note that all businesses need to obtain a business license. There are several reasons that you need a business license, but in your case, the main reason is that part of the business license is the health permit that is in the inspection you get once you apply to obtain a business license.

Finally,
If you hire food waitresses and other personnel, you will need to obtain a federal and state EIN as well, so you can pay federal and state withholding employment taxes.

A Seller's Permit is also required to sell any merchandise or food (any tangible / touchable product) .

Good morning, I would like to know how do I obtain a license to buy food wholesale? I am planning to sell simple organic superfoods and drinks from a van - what licensing do I need for vendor Encinitas CA and for food in general? How to get a food license?

All businesses need at least 2-5 business registration, so you will still need other registrations, such as licenses, an assumed business name DBA, and tax IDs as described above.

In addition, even one person, sole owner/proprietors working from home or just online can form an LLC or incorporate, in which case, they will not need to file a DBA, and they will be members of the LLC .

Selling food requires that you get a seller's permit because you will need it to buy the food items wholesale and sell them retail.

For instance, you can buy your food prepared items tax-free and when you serve and sell food, you will also need the permit to charge taxes.

For example, if a type of super food you sell sells for $15 and the sales tax rate is 10%, you will have to collect an additional $1.50 for sales tax, so the total in this case would be $16.50.

What does it take to legally open a prepared food concession business in Lomita, CA?

William wrote: “I am a Navy vet looking to start a nonprofit food service business with a focus on low-income areas. I will also be selling items on eBay.”

Hi William, The Lunch Box Café Food Service is off to a smart start by getting the paperwork right first. Starting with a booth instead of a restaurant keeps costs modest while you test recipes and prices with real customers. You told us you want to protect your personal assets, limit exposure from sales, clients, employees, or debt and look more credible to customers and banks, and that is exactly what an LLC is built for. Here is what we will cover: how to structure The Lunch Box Café Food Service, the tax IDs it needs, and the licenses that let you open in Lomita, then a quick recap.

Serving meals in low-income areas is a mission, and the structure has to match it: an LLC is a for-profit entity, while tax-exempt status comes only with a nonprofit corporation, bylaws, and an exemption application, so you may end up with two entities, a nonprofit for the food service and an LLC for your eBay sales. California requires a food facility permit for serving meals and a California seller's permit for the eBay side. Thank you for your service. Because credibility with donors and banks matters, keep the books for each entity completely separate. With two employees, open a California payroll account.

What The Lunch Box Café Food Service needs

  1. LLC (limited liability company) – An LLC keeps business debts and lawsuits separate from your personal home and savings. If several customers fall ill after eating at your booth and file suit, an LLC shields your house and savings. Once profits grow, an LLC can elect S corporation tax treatment, which can lower self-employment tax; ask a tax adviser when the numbers justify it.
  2. California fictitious business name statement – Registering "The Lunch Box Café Food Service" tells the public who stands behind the name. If you form an LLC under that exact name, the LLC filing itself protects the name and a separate DBA is usually unnecessary.
  3. EIN (federal tax ID number) – You plan on 2 employees, so the federal tax ID number (EIN) is required for payroll, and you will also use it for the business bank account and supplier accounts.
  4. California seller's permit – Register before the first sale. If online orders from another state grow large, that state may expect you to register there too, since each state sets its own sales threshold.
  5. California employer ID – With 2 employees, you need a state employer account number for payroll withholding and unemployment insurance. It works like the EIN, but for state payroll taxes.
  6. Business license – Most places require a local business license to operate, including home-based businesses. Check the rules where The Lunch Box Café Food Service will operate in Lomita, and ask about home occupation and zoning rules if you work from home. Expect a health inspection of the kitchen, truck, or premises; renting time in a licensed commercial kitchen is a common way to start.
  7. Food service permit – Selling cooked food at markets or festivals typically requires a permit and inspection, and some areas require a licensed commissary kitchen.
  8. Food handler card – Many states require food workers to finish a basic food safety course.

By the numbers: Banks, insurers, and tax forms will ask for your industry code. For a prepared food concession business it is NAICS 722330 (Mobile Food Services). With 2 employees planned, you are already creating jobs in Lomita. That makes 8 items on your list.

Answer:

Hi William, we can help you register for our Food Service in Lomita, CA, 90717.
Note that nonprofit requires a nonprofit corporation and bylaws as well as a tax exemption.
First,
thing to do is the entity tax structure selection. There are 4 main types of tax entity business structures, namely, sole proprietor, LLC, Partnership or Corporation.

In your case, since you showed an interest that you prefer an LLC, then form an LLC.

Second,
Because Food Service is subject to sales tax, you will need to obtain a seller’s permit.

I need advice on business insurance, finding investors, a website and advertising for my record label. Does the LLC service include the state fee and an operating agreement?
10/14/2026 5:04 AM

For a record label, an LLC is the right base. You handle artists' contracts, royalties and releases, and the LLC separates any dispute from your personal assets. The state's filing charge is shown apart from our service fee on the order page, and the operating agreement is prepared with your LLC, so your bank can open the account.

• Insurance: ask an insurance agent about general liability and media liability for a label, plus coverage for equipment.
• Investors: they usually want a formed LLC, an operating agreement and clean books first, then a clear plan for how their money is used.
• Website and advertising: register the name and open the bank account before you spend on promotion.

A surety bond is not what you need. Insurance protects you from claims, while bonds guarantee performance in certain regulated trades.

Do I need an LLC and a tax ID if my items are not taxable in my state? I also need to register a business at an address in Georgia.
10/14/2026 5:04 AM

Yes, an LLC still makes sense even when your products are not taxable. Taxability is only about sales tax, while the LLC is about protecting your personal assets from product and customer claims, and about credibility. With investors in mind, a formal company is what they will want to see.

On the tax ID, you still need an EIN for banking and federal taxes, since that is separate from sales tax. A seller's permit may not be needed if everything you sell is exempt, but many suppliers and marketplaces still ask for one, so check with them. Health and beauty products can be taxable in other places, so check where you sell.

For the Georgia address, I cannot supply an office location. Register the business at the real place where you operate, or use a registered agent's address for state papers. A local business license depends on that location.

I live in New York and want to start a mobile petting zoo. I also want to sell gift baskets by taking the order and having a company ship it. What do I need, and can I charge sales tax?
10/14/2026 5:04 AM

A mobile petting zoo carries real risk, since children and animals mix and a bite or a fall could lead to a claim. An LLC is the proper vehicle, because it separates that exposure from your personal assets, and it can bring in investors. A foreign owner is fine for an LLC.

• Petting zoo: animal exhibits are regulated, so expect animal health paperwork, permits for events, and liability insurance that venues will ask for.
• Business license, locally, plus approvals for each event location.
• EIN, for banking and taxes.

For the gift baskets, to charge sales tax you need a seller's permit, which in New York is registered as a certificate of authority. Even if you never touch the product or the money, if you take the order and your company is the seller, you generally must be registered to collect tax. If the other company is the seller of record, it may handle that, so clarify who sells.

In New York, the sales tax registration is called a certificate of authority, and a reseller's permit is built on it, so you do need one for your LLC. We can file it with expedited handling, which moves faster than standard processing, but I cannot promise a specific number of days because timing depends on the application.

Home inspection is a service, so the permit matters mainly if you also sell products or tools that are taxable. Your LLC fits the business well: inspectors face claims when something is missed, and the LLC separates those from your personal assets.

• Zoning: a home office is usually allowed, but you do not need a vote from the town council in most cases. Ask locally whether a home occupation approval applies.
• Professional license: home inspectors are licensed in many places, so confirm before you take clients.

File the certificate of authority well before your first sale, since New York asks that you register in advance.

What license do I need to buy seafood in Louisiana, transport it to Tennessee and sell it to restaurants and the public, and do I need a wholesale license?

Form an LLC before anything else. Moving fresh shrimp and other seafood across state lines involves spoilage, illness and vehicle risks, and the LLC protects your personal assets while showing restaurants that they are dealing with an established company. A foreign owner can hold an LLC, too.

• EIN, for the account, payroll and supplier accounts.
• Seller's permit: it works as your wholesale and resale registration, so you can buy without tax and sell with tax. You may need one wherever you sell.
• Seafood dealer permit: seafood is regulated at each step, including buying, cold storage and delivery, so ask where your product is sourced and sold.
• Business license, locally.

Whether you open a fish market or a restaurant, each needs its own food permits and inspections.
